1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the PhoneValidation API service ("Service") operated by SecureMyData, a Entreprise Individuelle registered in France (Entreprise Individuelle / SIREN: 805027760 / SIRET: 80502776000026 / VAT: FR87805027760).

By accessing or using the Service at phonevalidationapi.com, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Definitions

• "Service" refers to the PhoneValidation API, website, documentation, API, dashboard, and all related services.
• "User", "you", "your" refers to any individual or entity accessing or using the Service.
• "We", "us", "our" refers to SecureMyData.
• "API Key" refers to the unique authentication credential issued to access the Service.
• "Credit" refers to a unit of consumption — 1 credit = 1 API call (typically one email validation).

3. Account Registration

To use the Service, you must create an account, verify your email address, and provide accurate information. You are responsible for:

• Maintaining the confidentiality of your account credentials and API keys.
• All activities that occur under your account.
• Notifying us immediately of any unauthorized use of your account.

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to create an account.

4. Service Description

PhoneValidation provides a REST API that validates phone numbers in real time, including format check (E.164), country and region detection, carrier identification, line-type classification (mobile, landline, VoIP, toll-free, premium-rate), and disposable/burner phone filtering. The Service includes a web dashboard for account management, batch processing, and usage analytics.

5. Pricing & Credits

The Service operates on a pay-as-you-go credits model. New accounts receive a fixed amount of free trial credits upon email verification. Additional credits can be purchased in any amount within the allowed range from the billing dashboard. Credits never expire.

Pricing is denominated in US Dollars (USD). The unit price decreases smoothly with deposit volume — see the pricing page for the live calculator. Applicable taxes may be added based on your location.

We reserve the right to modify pricing with 30 days' prior notice. Existing credits remain redeemable at their current value.

6. Payment and Billing

All payments are processed by Stripe. By making a purchase, you also agree to Stripe's Terms of Service and Privacy Policy. We do not store credit card information.

Auto top-up: if you enable auto top-up, you authorize us to charge your saved card automatically when your balance drops below the threshold you choose. You can disable this at any time from the billing dashboard.

7. Refunds

See our Refund Policy for details. In short: unused credits purchased within the last 14 days may be refunded on request; consumed credits and free trial credits are non-refundable.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws or regulations.
• Use the Service to validate email addresses you do not have a legitimate reason to validate (e.g., harvesting, unsolicited verification of third-party lists).
• Resell, redistribute, or sublicense access to the API or API keys without our prior written consent.
• Attempt to circumvent rate limits, usage quotas, or security measures.
• Reverse-engineer, decompile, or attempt to derive the source code of the Service.
• Use the Service to build a directly competing product.
• Share, publish, or expose your API keys publicly.

9. Rate Limits and Quotas

Each endpoint enforces specific rate limits documented in the documentation. Excess requests will be throttled with HTTP 429 responses. Sustained abuse may result in account suspension.

10. Intellectual Property

The Service, including its design, code, documentation, and branding, is the property of SecureMyData and is protected by intellectual property laws. The validation results returned by the API are provided to you for your own application use; redistribution as a standalone dataset is prohibited.

11. Service Availability & Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind. We strive for high availability but do not guarantee uninterrupted access. We disclaim all warranties to the maximum extent permitted by law.

In no event shall SecureMyData be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue. Our total aggregate liability for any claims shall not exceed the amount you paid us in the 12 months preceding the claim.

Email validation is inherently probabilistic. Some providers (e.g., Proton, Tutanota, strict corporate MX) actively block SMTP probes. We provide transparent confidence levels and reason codes; we do not guarantee any specific accuracy figure.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for violation of these Terms, abusive use, or non-payment. You may close your account at any time from the dashboard or by contacting us.

13. Data Protection

We process personal data in accordance with our Privacy Policy and the EU GDPR. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

14. Modifications to Terms

We reserve the right to update these Terms. Material changes will be communicated to registered users by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of France. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Grenoble, France.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
